What is Transgender Bill, 2019 #UPSC

The Transgender Persons (Protection of rights) Bill,2019 ministry of social justice and empowerment whose minister is Shri Thaawarchand Gehlot (Lok Sabha).
Transgender community is among one of the most marginalized communities in our country(India) because they don't fit into the stereotypical categories of gender of men and women. They are still facing problems like lack of Educational facilities, Unemployment, Medical Facilities and still not getting acceptance in our society. This bill shall empower the transgender community Socially, Educationally and Economically.

➣Who should be considered as Transgender Persons?
One whose gender does not assigned at birth it includes transmen, transwomen and intersex variations gender-queers and socio-culture identities.

In the year 2014, judgement given by supreme court was to give rights to transgender community as a third gender and gave them the right to identification and provide reservation for this third gender.

Section 377
Any unnatural offence and says whoever has carnal intercourse against the order of nature with any man,woman or animal shall be punished with imprisonment for life or for at least 10 years and shall also be liable to pay a fine. Section 377 is not completely removed but, consenting same sex adults should not be decriminalized.

Rights
Right of residence should be given to them means that they have the right to reside and live in their household and if their family don't allow them to reside in their own house then government of India will also made rehabilitation center. No government or any private entity/company can deny them(transgender) or discriminate against transgender person in employment including recruitment and promotion.

Educational Field
In the year 2011, Transgender illiteracy rate was 56.07%.
Institution will be funded by government of India and Sports and Recreation Facility also be provided to them and government must take steps to provide health facilities to transgender persons including separate HIV surveillance centers, and sex reassignment surgeries(if they want).

NCT National Council for Transgender Persons
  • Union Minister for social Justice(Chairperson),
  • Minister of state for social justice(Vice chairman),
  • Secratory of the Ministry of Social Justice,
  • Other members including NITI Aayog and the National Human Rights Commission, state government will also be represented including one representative from ministries including Health, Home Affairs and Human Resource Development.
  • The council will also consist of five member from the transgender community and five experts from the non-governmental organization.
➣Purpose of forming this Council?
This council will advice the central government and will monitor the impact on Policies, Legislation and Projects with respect to transgender persons. It will also redress the grievances of transgender persons.
